Lok Sabha Passed Triple Talaq Bill
Triple Talaq Bill criminalising instant divorce passed in Lok Sabha last Thursday. According to bill, now triple talaq will be banned in India. Government asserted that the law was required as there were hundreds of cases of instant divorce have come to known. In voting 303 votes were done in support of passing the bill while 82 against against triple talaq bill.
Talking about it, Law Minister Ravi Shankar Prasad said the law was also required to prescribe punishment for those violating Muslim Women (Protection of Rights on Marriage) Bill, 2019. Prasad said 574 cases of triple talaq were reported since January 2017 and 101 after the issuance of an Ordinance in this regard.
Adding more, the minister also said that despite judgement of the apex court in the August 2017, the instant talaq cased were reported. This created an urgency to create law. The Bill prescribes a jail term of up to 3 years for the husband for pronouncing triple talaq, he added.
What is Triple talaq in India?
Triple Talaq, also known as talaq-e-biddat is the form of giving divorce in India used by Muslims. It allows a Muslim person to give divorce to his wife legally just by saying word “Talaq” three times. The divorce can be given in any form in oral, written, or more recently, electronic form.
This has created controversy in India. Many Muslim women have moved to the court in past against this practice. Even Supreme Court of India on 22 August 2017 deemed instant triple talaq (talaq-e-biddah) unconstitutional. Three judges out of five had declared it unconstitutional while rest of the two called it constitutional.
